- If you choose to create a personalized Chatbot using our Platform, either for yourself or on behalf of another person, you consent to be video recorded and your voice being recorded while using the Platform to create the customized Chatbot with your designated face and voice.
- By using the Platform and selecting this option, you grant us your consent and authorization for the use of your personal image or the image of the designated person. This includes but is not limited to, the following rights: (i) name; (ii) physical appearance; (iii) voice; (iv) gestures; (v) slogan; (vi) phrases; (vii) iconic movements; (viii) signature; and all other rights related to your or the designated person’s image (the “Image Rights“). These rights are solely for the purpose of creating the personalized Chatbot, specifically for the creation of the avatar, which may involve collaboration between the Platform and additional third-party software. For this purpose, you grant us your consent and authorization to transmit and share the Image Rights with third parties, strictly for the purposes outlined in this Privacy Policy.
6. Transferring personal data to the U.S:
- Information collected about you will undergo processing in the United States. By utilizing the Platform services, you acknowledge that your personal information will undergo processing in the United States. The United States has not sought nor received a determination of “adequacy” from the European Union as outlined in Article 45 of the General Data Protection Regulation (GDPR). Pursuant to Article 46 of the GDPR, Webtronic Labs LLC is establishing appropriate safeguards by implementing binding, standard data protection clauses, enforceable by data subjects in the EEA and the UK. These clauses have been enhanced based on guidance from the European Data Protection Board and will be updated upon approval of new draft model clauses.
- Depending on the circumstance, Webtronic Labs LLC also collects and transfers personal data to the U.S. with consent; to fulfill a contract with you; or to satisfy a compelling legitimate interest of Webtronic Labs LLC in a manner that does not override your rights and freedoms. Webtronic Labs LLC endeavors to apply appropriate safeguards to safeguard the privacy and security of your personal data and to use it only in accordance with your relationship with Webtronic Labs LLC and the practices outlined in this Privacy Statement. Webtronic Labs LLC also enters into data processing agreements and model clauses with its vendors whenever feasible and appropriate.
